Terms of Service

1. Acceptance of Terms

By accessing or using Whistle AI (“the Service”) at usewhistle.co or app.usewhistle.co, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Whistle AI is a keyword intelligence platform that connects to your Google Search Console (GSC) account to analyze your search data, identify opportunities, detect keyword cannibalization, and generate SEO insights and reports.

3. Account Registration

To use the Service, you must create an account using Google OAuth via Clerk. You are responsible for:

• Maintaining the security of your account
• All activity that occurs under your account
• Providing accurate and complete information
• Promptly notifying us of any unauthorized access

You must be at least 16 years old to create an account.

4. Google Search Console Integration

By connecting your GSC account, you authorize Whistle AI to access and process your Search Console data on your behalf. You represent that:

• You have the right to authorize this access
• The GSC properties you connect belong to you or your organization
• You will not use the Service to access data you are not authorized to access

You can revoke GSC access at any time via your Google Account settings at myaccount.google.com/permissions.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any laws
• Attempt to gain unauthorized access to any part of the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated scripts or bots to access the Service without written permission
• Resell or redistribute access to the Service without authorization
• Upload or transmit viruses or malicious code
• Interfere with the proper functioning of the Service

6. Intellectual Property

The Service, including its algorithms, analysis methods, software, interface, and branding, is the property of Whistle AI and protected by intellectual property laws.

Your GSC data and any content you provide remain yours. You grant us a limited license to process your data solely to provide the Service.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that:

• The Service will be uninterrupted or error-free
• The analysis results will be accurate or complete
• The Service will meet your specific requirements
• Any defects will be corrected

SEO insights and recommendations are informational only. Whistle AI does not guarantee specific ranking improvements or traffic outcomes.

9. Limitation of Liability

To the maximum extent permitted by law, Whistle AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities arising from your use of the Service.

Our total liability for any claims arising from use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

Either party may terminate the agreement at any time. We reserve the right to suspend or terminate your account if you violate these Terms.

Upon termination, your right to use the Service ceases immediately. We will delete your data within 30 days per our Privacy Policy.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or a notice in the app. Continued use of the Service after changes constitutes acceptance.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through good-faith negotiation first, then binding arbitration.
